This Health and Medical Disclaimer is an essential part of your agreement with XEEP PLT (Company Registration No. 202504002688) and must be read carefully before using the Xeep wellness platform, Xeep Device, or any related services (collectively, "Xeep Services"). By creating a Xeep account, pairing a Xeep Device, or using any Xeep Services, you acknowledge that you have read, understood, and expressly agreed to this Health and Medical Disclaimer in its entirety.

IF YOU DO NOT AGREE WITH ANY PART OF THIS DISCLAIMER, DO NOT USE XEEP SERVICES.

1. Not a Medical Device

1.1 Wellness Product Classification

The Xeep Device and Xeep Services are designed and marketed as general wellness and fitness products for health-conscious individuals who wish to track their wellness metrics, optimize their daily performance, and receive insights about their flow state readiness. Our products and services are NOT medical devices and have NOT been evaluated, approved, registered, or cleared by any medical regulatory authority, including but not limited to:

  • Medical Device Authority (MDA) of Malaysia
  • United States Food and Drug Administration (FDA)
  • European Medicines Agency (EMA)
  • Therapeutic Goods Administration (TGA) of Australia
  • Any other national or international medical device regulatory body

1.2 No Medical Claims

Xeep makes no claims that our products or services can diagnose, treat, cure, prevent, or monitor any disease, medical condition, or health disorder. The Xeep Device and platform do not provide medical diagnoses, medical advice, medical treatment recommendations, or clinical decision support. Our products and services are intended solely for general wellness, fitness tracking, and personal productivity optimization.

The XQ (Flow State Intelligence) score is a proprietary wellness metric designed to help users identify optimal times for focused work and productivity. It is NOT a medical score, clinical assessment, or diagnostic indicator of any medical condition. The XQ algorithm analyzes patterns in your wellness data to provide insights about your readiness for cognitive performance, not to assess your medical health status.

1.3 Regulatory Status

Xeep does not currently hold, nor do we claim to hold, any medical device certifications, approvals, or registrations. We have not submitted our products for medical device review and we do not intend to market them as medical devices. Our products are consumer wellness devices subject to general consumer product safety regulations, not medical device regulations.

If Xeep pursues medical device certification in the future, we will clearly communicate such changes to users and update our marketing materials and documentation accordingly. Until such certification is obtained, all statements in this Disclaimer remain applicable.

2. Blood Pressure Measurement Limitations

2.1 Algorithmic Estimation Methodology

The Xeep Device uses proprietary algorithmic techniques to estimate blood pressure readings based on various physiological signals collected by the device's sensors. These blood pressure estimates are derived through computational analysis of sensor data, including but not limited to pulse wave analysis, heart rate patterns, and other hemodynamic indicators. The estimates are NOT direct blood pressure measurements obtained through validated clinical methodologies such as auscultatory measurement or oscillometric measurement used in medical-grade blood pressure monitors.

2.2 Accuracy and Confidence Levels

The confidence level for Xeep's blood pressure estimates ranges from sixty percent (60%) to eighty-five percent (85%), depending on various factors including device placement, skin contact quality, user movement, individual physiological characteristics, and environmental conditions. This confidence level is significantly lower than medical-grade blood pressure monitors, which typically achieve accuracy levels exceeding ninety-five percent (95%) when used properly.

You must understand and accept that:

  • Blood pressure estimates may be inaccurate by significant margins
  • Estimates may not reflect your actual blood pressure at any given time
  • Accuracy varies substantially between individuals and circumstances
  • The device cannot detect dangerous blood pressure levels reliably
  • Normal readings from the device do NOT confirm healthy blood pressure
  • Abnormal readings from the device may be false positives or false negatives

2.3 Not for Medical Use

CRITICAL WARNING:

The Xeep Device's blood pressure estimation feature is NOT suitable for any medical purpose and must NOT be used:

  • To diagnose hypertension, hypotension, or any cardiovascular condition
  • To guide treatment decisions for blood pressure disorders
  • To adjust medication dosages for blood pressure management
  • To monitor blood pressure for patients with diagnosed hypertension or cardiovascular disease
  • To determine need for medical intervention or emergency care
  • To replace regular blood pressure monitoring advised by your healthcare provider
  • For clinical decision-making of any kind

2.4 When to Use Medical-Grade Monitoring

You should use medical-grade blood pressure monitoring equipment and consult with healthcare professionals if:

  • You have been diagnosed with hypertension, hypotension, or any cardiovascular condition
  • Your healthcare provider has recommended regular blood pressure monitoring
  • You are taking medications that affect blood pressure
  • You have diabetes, kidney disease, or other conditions affecting cardiovascular health
  • You are pregnant or planning pregnancy (blood pressure monitoring is critical)
  • You have a family history of cardiovascular disease or stroke
  • You experience symptoms that may indicate blood pressure issues such as severe headaches, chest pain, difficulty breathing, dizziness, blurred vision, or nosebleeds
  • You are over the age of forty, at which point regular blood pressure screening becomes more important

3. General Health Monitoring Limitations

3.1 Consumer-Grade Sensors and Technology

The Xeep Device utilizes consumer-grade sensors and measurement technologies that, while advanced for consumer wellness applications, do not meet the precision, accuracy, or reliability standards required for medical devices. All health metrics provided by Xeep, including but not limited to heart rate, blood oxygen saturation (SpO2), sleep analysis, stress levels, heart rate variability (HRV), physical activity measurements, and other physiological data, are subject to inherent limitations and measurement errors.

3.2 Factors Affecting Accuracy

The accuracy and reliability of measurements obtained through the Xeep Device may be significantly affected by numerous factors, including but not limited to:

Device-Related Factors:

  • Sensor quality variations between individual units
  • Device firmware version and software updates
  • Battery charge level affecting sensor performance
  • Age and wear of the device impacting sensor sensitivity
  • Device positioning and fit on the wrist
  • Environmental conditions such as temperature and humidity
  • Interference from other electronic devices or electromagnetic fields

User-Related Factors:

  • Skin characteristics including tone, thickness, texture, and moisture level
  • Presence of tattoos, scars, or skin conditions in the sensor contact area
  • Amount and distribution of subcutaneous fat
  • Wrist size and bone structure
  • Hair density on the wrist
  • Body temperature and circulation
  • Movement during measurement
  • Physical activity level at time of measurement
  • Hydration status
  • Recent food, caffeine, or alcohol consumption
  • Stress, anxiety, or emotional state
  • Sleep deprivation or fatigue
  • Medications that affect heart rate, blood flow, or other physiological parameters
  • Individual physiological variations that differ from population norms

Environmental Factors:

  • Ambient temperature (very hot or cold conditions)
  • Altitude (high altitude affects oxygen saturation readings)
  • Air quality and pollution levels
  • Humidity levels
  • Lighting conditions (may affect certain optical sensors)

3.3 Intended Use as General Wellness Indicators

All health metrics provided by Xeep Services are intended as general wellness indicators to help you understand trends and patterns in your physiological data over time. These metrics can provide useful information for general fitness tracking, activity monitoring, and personal wellness awareness. However, they should be interpreted as approximations and estimates rather than precise medical measurements.

Wellness trends observed over days, weeks, and months may have more value than individual readings at specific moments. Focus on long-term patterns rather than reacting to individual measurements that may be affected by transient factors or measurement errors.

3.4 Not a Substitute for Medical-Grade Monitoring

Xeep Services do NOT replace professional medical monitoring or assessment. If you have any medical condition that requires monitoring of heart rate, blood oxygen, sleep quality, or other physiological parameters, you must use medical-grade monitoring equipment prescribed or recommended by your healthcare provider. Examples of medical-grade monitoring include but are not limited to pulse oximeters for chronic respiratory conditions, holter monitors for cardiac arrhythmias, sleep study equipment for diagnosed sleep disorders, and continuous glucose monitors for diabetes management.

Do not use Xeep Services as your sole or primary method of monitoring any medical condition. Medical-grade devices undergo rigorous clinical validation, regulatory review, and quality control processes that consumer wellness devices do not.

4. No Medical Advice Provided

4.1 Information for Educational Purposes Only

Any information provided through Xeep Services, including wellness insights, AI-generated recommendations, health tips, educational content, XQ score interpretations, and other guidance is provided for informational and educational purposes only. This information is NOT medical advice, clinical guidance, diagnosis, or treatment recommendations.

The AI-powered insights and recommendations generated by our platform are based on analysis of your wellness data patterns and population-level research. These insights are designed to provide general wellness suggestions that may help you optimize your daily routines, improve sleep habits, manage stress, and enhance productivity. However, artificial intelligence systems have inherent limitations and cannot account for your complete medical history, current health status, medications, individual circumstances, or medical complexities that only a qualified healthcare provider can assess.

4.2 Not a Substitute for Professional Medical Consultation

Xeep is NOT a substitute for professional medical advice, diagnosis, or treatment.

You should not rely exclusively on information from Xeep Services to make health decisions. Always seek the advice of your physician, licensed healthcare provider, or other qualified health professional with any questions you may have regarding:

  • Medical conditions or symptoms you are experiencing
  • Interpretation of health metrics or concerning trends in your data
  • Whether lifestyle changes suggested by Xeep are appropriate for your situation
  • Medication adjustments or interactions
  • Need for medical testing, evaluation, or treatment
  • Management of chronic health conditions
  • Fitness program suitability given your health status
  • Dietary changes or nutritional supplements
  • Mental health concerns
  • Any other health-related matters

4.3 Never Disregard or Delay Professional Medical Advice

Never disregard professional medical advice, delay seeking medical attention, or discontinue medical treatment based on information you receive from Xeep Services. If you have received specific medical advice or instructions from your healthcare provider, always follow that guidance over any general wellness information provided by Xeep. If information from Xeep conflicts with your healthcare provider's advice, discuss the discrepancy with your provider rather than making independent decisions.

If you are currently under medical care for any condition, inform your healthcare provider that you are using Xeep wellness tracking services. Your healthcare provider can help you understand how to interpret your wellness data in the context of your specific medical situation and advise whether the general wellness insights provided by Xeep are appropriate for you.

5. Emergency Situations

5.1 Not for Emergency Detection or Response

CRITICAL WARNING:

Xeep Services are NOT designed to detect medical emergencies and will NOT alert you to emergency situations. Do not rely on Xeep to warn you of dangerous health conditions or life-threatening situations. The Xeep Device and platform cannot reliably detect heart attacks, strokes, severe arrhythmias, respiratory failure, diabetic emergencies, seizures, or other acute medical emergencies.

Even if your Xeep data shows unusual readings or abnormal patterns, the device may not detect serious medical conditions that require immediate attention. False negatives (failing to detect real problems) are possible and even likely given the limitations of consumer wellness devices. Conversely, unusual readings may be measurement errors or false alarms rather than indicators of genuine medical problems.

5.2 When to Seek Immediate Medical Attention

If you experience any symptoms or signs of a medical emergency, immediately call emergency services (dial 999 in Malaysia) or go to the nearest hospital emergency department. Do NOT check your Xeep Device first, wait to see if symptoms resolve, or delay emergency care to review your wellness data. Common medical emergency symptoms include but are not limited to:

Cardiovascular Emergencies:

  • Chest pain, pressure, tightness, or discomfort, especially if radiating to arm, jaw, or back
  • Severe shortness of breath or difficulty breathing
  • Sudden weakness, numbness, or paralysis, especially on one side of the body
  • Sudden severe headache with no known cause
  • Loss of consciousness or fainting
  • Rapid, slow, or irregular heartbeat accompanied by other symptoms
  • Sudden confusion, difficulty speaking, or difficulty understanding speech
  • Sudden vision changes or loss of vision

Respiratory Emergencies:

  • Severe difficulty breathing or inability to catch your breath
  • Blue discoloration of lips, face, or fingernails
  • Choking or inability to speak or cough
  • Severe asthma attack not responding to usual medication

Other Serious Symptoms:

  • Severe bleeding that won't stop
  • Severe burns
  • Severe allergic reactions (anaphylaxis) with swelling, difficulty breathing, or rash
  • Poisoning or drug overdose
  • Severe injury from accidents or falls
  • Seizures, especially if lasting more than a few minutes or occurring repeatedly
  • Sudden severe abdominal pain
  • Coughing or vomiting blood
  • Suicidal thoughts or intent to harm yourself or others

5.3 Limited Response Time for Support

Even if you contact Xeep support about concerning health readings or symptoms, our response time (twenty-four to forty-eight hours for customer support) is far too long for emergency situations. Our support team consists of customer service representatives, not medical professionals, and they cannot provide medical advice or emergency assistance. Never contact Xeep support as a substitute for emergency medical services.

6. Pregnancy and Special Medical Conditions

6.1 Pregnancy Considerations

If you are pregnant, planning pregnancy, or breastfeeding, you should consult your healthcare provider before using Xeep Services and discuss whether wellness tracking is appropriate for your situation. Pregnancy significantly affects many physiological parameters tracked by Xeep, including heart rate, blood pressure, sleep patterns, and activity capacity. Normal ranges for these parameters change throughout pregnancy, and the Xeep algorithms are not specifically calibrated for pregnant users.

Furthermore, wellness recommendations generated by Xeep AI may not be appropriate during pregnancy. Exercise recommendations, stress management techniques, and lifestyle suggestions may need modification during pregnancy. Always follow your obstetrician's or midwife's guidance regarding appropriate activities, monitoring, and lifestyle during pregnancy rather than relying on general wellness insights from Xeep.

6.2 Chronic Medical Conditions

If you have any chronic medical condition, you should consult your healthcare provider before using Xeep Services and discuss how to appropriately interpret wellness data in the context of your condition. Chronic conditions that warrant special consideration include but are not limited to:

Cardiovascular Conditions:

  • Hypertension (high blood pressure)
  • Coronary artery disease
  • Heart failure
  • Arrhythmias (irregular heartbeat)
  • Prior heart attack or stroke
  • Valvular heart disease
  • Congenital heart defects

Respiratory Conditions:

  • Chronic obstructive pulmonary disease (COPD)
  • Asthma
  • Sleep apnea
  • Pulmonary hypertension
  • Chronic bronchitis or emphysema

Metabolic and Endocrine Conditions:

  • Diabetes (Type 1 or Type 2)
  • Thyroid disorders
  • Metabolic syndrome
  • Obesity

Other Conditions:

  • Epilepsy or seizure disorders
  • Multiple sclerosis
  • Parkinson's disease
  • Kidney disease
  • Liver disease
  • Autoimmune disorders
  • Cancer (current or in treatment)
  • Any condition requiring regular medical monitoring

6.3 Medication Considerations

Many medications affect physiological parameters tracked by Xeep, including heart rate, blood pressure, sleep quality, and activity tolerance. If you are taking any medications, particularly those affecting the cardiovascular system, nervous system, or metabolic function, be aware that your wellness data may reflect medication effects rather than your underlying wellness state. Examples of medications that may significantly affect tracked parameters include beta-blockers, calcium channel blockers, diuretics, stimulants, sedatives, antidepressants, and thyroid medications.

Never adjust medication dosages based on Xeep data without consulting your healthcare provider. If you notice changes in your wellness metrics after starting, stopping, or changing medication doses, discuss these observations with your healthcare provider rather than making independent decisions.

7. Children and Minors

7.1 Age Restriction

Xeep Services are intended exclusively for adults aged eighteen years and older. We do not knowingly collect health data from or market our services to individuals under eighteen years of age. The Xeep Device should not be used by children or minors under eighteen.

7.2 Parental or Guardian Supervision

If a minor between the ages of thirteen and eighteen uses Xeep Services under parental or legal guardian supervision with the parent's or guardian's Xeep account, the parent or legal guardian assumes full responsibility for the minor's use of the services. The parent or guardian acknowledges that Xeep Services are designed for adults and that wellness recommendations, normal ranges, and AI insights may not be appropriate for developing bodies and physiologies.

Parents and guardians must consult with a pediatrician or pediatric specialist before allowing minors to use wellness tracking devices or before relying on any wellness data or insights for minors. Pediatric physiological norms differ significantly from adult norms, and adult-calibrated devices may provide inaccurate or misleading information for children.

8. User Responsibilities

8.1 Informed Use

By using Xeep Services, you acknowledge and accept full responsibility for:

  • Understanding the limitations and disclaimers outlined in this document
  • Not relying on Xeep data or insights for medical decision-making
  • Continuing to seek appropriate medical care from qualified healthcare providers
  • Using Xeep as a general wellness tool only, not a medical monitoring device
  • Recognizing that unusual readings may be measurement errors rather than real health concerns
  • Not panicking or making hasty decisions based on individual data points
  • Discussing Xeep wellness data with your healthcare provider if you have health concerns
  • Maintaining appropriate medical monitoring if you have chronic conditions
  • Following medical advice from your healthcare provider over general wellness insights from Xeep

8.2 Regular Medical Check-Ups

Use of Xeep Services does NOT replace the need for regular medical check-ups, health screenings, and consultations with healthcare providers. Even if your Xeep data appears normal and your XQ scores are consistently high, you should continue routine medical care as recommended by healthcare guidelines for your age, sex, and risk factors. Many serious medical conditions have no symptoms in early stages and cannot be detected by consumer wellness devices.

Adults should generally undergo annual physical examinations, regular blood pressure checks, periodic cholesterol screening, and other age-appropriate preventive health screenings as recommended by medical guidelines. Consult your healthcare provider to understand which screenings and check-ups are appropriate for you.

8.3 Lifestyle Changes and Exercise

If you plan to make significant lifestyle changes based on insights from Xeep Services, including starting a new exercise program, significantly increasing exercise intensity or duration, making major dietary changes, or implementing new stress management techniques, you should consult with your healthcare provider first, particularly if you have any chronic medical conditions, are over the age of forty, have been sedentary for an extended period, have a family history of heart disease, or have other risk factors for cardiovascular disease.

9. Assumption of Risk

9.1 Voluntary Use

Your use of Xeep Services is entirely voluntary. By choosing to use Xeep Services, you explicitly acknowledge and voluntarily assume all risks associated with reliance on consumer wellness devices and wellness information, including but not limited to the risks that:

  • Health measurements may be inaccurate, incomplete, or misleading
  • Important health issues may go undetected by the device
  • You may experience adverse health outcomes despite normal Xeep readings
  • Wellness recommendations may not be appropriate for your individual circumstances
  • AI-generated insights may be based on incomplete or inaccurate analysis
  • Technical malfunctions or errors may affect data accuracy
  • Following wellness recommendations may lead to unintended consequences

9.2 No Liability for Health Outcomes

You expressly agree that Xeep shall have no liability whatsoever for any adverse health outcomes, medical conditions, injuries, illnesses, disabilities, or deaths that occur in connection with your use of Xeep Services or any reliance you place on data, insights, or recommendations provided through Xeep Services, whether such outcomes are caused by device malfunction, inaccurate data, inappropriate recommendations, delays in seeking medical care, or any other factor related to your use of our services.

This disclaimer of liability applies even if Xeep was negligent in designing, manufacturing, or providing its devices or services, to the fullest extent permitted by Malaysian law. However, this disclaimer does not affect your statutory consumer rights under Malaysian law, including rights under the Consumer Protection Act 1999.

9.3 Release of Claims

By using Xeep Services, you release, waive, discharge, and covenant not to sue Xeep PLT, its affiliates, officers, directors, employees, agents, contractors, and representatives from any and all claims, demands, actions, causes of action, damages, costs, and liabilities arising from or related to any health outcomes, medical conditions, injuries, or adverse events occurring in connection with your use of Xeep Services, except to the extent such release is prohibited by mandatory provisions of Malaysian law.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, Xeep's total liability for any health-related claims arising from or relating to your use of Xeep Services shall not exceed the amount you paid for Xeep products and services during the twelve months immediately preceding the event giving rise to liability, or one hundred Malaysian Ringgit (RM100), whichever is greater.

In no event shall Xeep be liable for any indirect, incidental, special, consequential, or punitive damages arising from health outcomes or medical conditions, including but not limited to medical expenses, hospitalization costs, lost income due to illness or disability, pain and suffering, or wrongful death, regardless of whether such damages were foreseeable and regardless of whether Xeep was advised of the possibility of such damages.

This limitation of liability applies to all legal theories, whether in contract, tort (including negligence), strict liability, warranty, product liability, or otherwise. Nothing in this section shall limit or exclude liability that cannot be limited or excluded under Malaysian law, including liability for death or personal injury caused by proven gross negligence or intentional wrongdoing.

11. Acknowledgment and Acceptance

By creating a Xeep account, pairing a Xeep Device, or using any Xeep Services, you acknowledge that you have carefully read this Health and Medical Disclaimer in its entirety, understand its contents, and expressly agree to all terms, limitations, disclaimers, and exclusions contained herein.

You specifically acknowledge and confirm your understanding that:

  • Xeep Device and Services are wellness products, NOT medical devices
  • Blood pressure estimates have sixty to eighty-five percent confidence only and must NOT be used for medical purposes
  • All health measurements have inherent limitations and may be inaccurate
  • Xeep does NOT provide medical advice, diagnosis, or treatment
  • Xeep cannot detect medical emergencies or replace emergency services
  • You must continue regular medical care and not rely on Xeep for health monitoring
  • You assume all risks associated with using consumer wellness devices
  • Xeep disclaims liability for health outcomes to the fullest extent permitted by law

If you do not accept this Health and Medical Disclaimer in full, you must immediately discontinue use of all Xeep Services and refrain from using the Xeep Device.

12. Updates and Modifications

We reserve the right to update or modify this Health and Medical Disclaimer at any time as we refine our services, add new features, or respond to regulatory developments or legal requirements. Material changes to this Disclaimer will be communicated to users at least thirty days before the changes take effect through email notification and prominent notice in the mobile application and website.

Your continued use of Xeep Services after any modifications to this Disclaimer constitutes your acceptance of the modified terms. If you do not accept the modifications, you must discontinue use of Xeep Services.
